“Mechanisms established under the African Charter, the African Court on Human and People’s Rights (the Court) and the African Commission on Human and Peoples’ Rights (the Commission), can be used by trade unions in Africa in order to campaign for and advocate workers’ rights. Their enhanced participation will strengthen these mechanisms and build strong regional jurisprudence on workers’ rights. This guide is intended to facilitate the effective access to the Court and the Commission by trade unions.

The first section highlights some rights which are protected by the Charter and are of direct relevance to trade unions. The second section explains how to bring a communication before the Commission. The third section explains step-by-step how trade unions can file a case and the course of proceedings at the Court. The last section describes the special procedures of the Commission and explains how to communicate workers’ rights violations to the relevant Special Rapporteur.
